    What are they even supposed to do in that case? They can't send him home but they can't keep him in jail either. Another few months in mental hospital?

    Could have sworn they were holding him until the trial because it was bumped up to a felony.

    The grand jury decides that but last we've heard it was a continence after which they sealed the case; so since that time they may have made their decision to go forward as a felony case.

    Because the case is 'sealed' we're not going to know ANYTHING for certain until August 2023 at the earliest.

    The charge was possibly bumped up to a felony to give the prosecution something they could hang over Chris's head. Otherwise, Chris–who has sat in jail for over a year on a misdemeanor charge (i.e. the maximum penalty for a misdemeanor)–could in theory walk away even with a guilty verdict.

    In America, your lawyer can waive the right to a speedy trial to buy time for a more solid defense. Chris is probably blindly agreeing to everything his lawyer asks and probably doesn't comprehend what his rights are or what they mean.

    Although the case is sealed we're able to see pleadings and orders, what we can't see are hearings and their results. We can come to some conclusions based on the little we have, but since Kegen cut ties with Chris and/or his lawyer potentially encouraging Chris to stop writing letters that can incriminate himself there's a lot we don't know. A theory that might hold some water is that Chris was told in no uncertain terms he was facing felony charges and has retreated from outside communication because of it.

    Wouldn't the charge have to have been bumped up to a felony? Can't we assume that with certainty, given that it would be illegal for them to hold him in jail for over a year on a misdemeanor?

    Maybe they've read into the stuff Chris said in the call and decided to charge him with rape?

    A did a bit more research and this is what I've found: the grand jury returned a continuance on the 8th of August then Halberd waived Chris's right to indictment that same day which means the case would proceed as is after this the case was sealed so we don't know what going on except that it is proceeding towards some kind of conclusion weather that be a plea bargain or not, so he's not going to be let out because of being held for a year without a charge. The motion to deffer the case was on the 5th, we don't know for sure if that was granted but Chris was sent a letter from the Department of Behavioral Health and Developmental Services so it's possible that's the direction Chris's lawyer is trying to take, that said it's equally possible an evaluation was done anyways to try to get a lighter sentencing asserting Chris's mental handicap would make him unsuitable for a long stint in prison. As I've said again and again, there is a lot we don't know so the only thing we can do is hope for the best and speculate with the limited information we have.

    Here's the other complicating factor that a lot of people (including me for a while) forgot:
    Chris actually committed two crimes.

    Not only the incest, but he stole money - from Barb's bank account - after being given an order not to contact her. I wonder how the authorities are going to pursue that charge.

    The only certainty is there isn't enough Tylenol to help the Virginia judiciary cope with the headache that is Chris-Chan.

    And their tragedy is they have to suffer in silence. For good or ill, the last thing the county wants is to bring more attention to this.
